Wealden District Council has given the green light for a one-bedroom apartment to be created in a space that previously housed a furniture outlet.
The authority confirmed on August 14 that planning permission is not needed to transform the empty retail unit on Crowborough Hill in Crowborough, previously used by TLC Furniture, into residential accommodation. The conversion will proceed under Class MA permitted development rules, which allow such changes of use without a full planning application. The applicant, Ablewhite Lettings Ltd, was required to seek confirmation from the local planning authority that prior approval was unnecessary before proceeding.
Following assessment, council planners concluded the proposal satisfies all applicable permitted development constraints.
This conclusion differed from the stance taken by Crowborough Town Council, which submitted objections urging rejection of the scheme on multiple grounds.
In its response to the application, the town council stated the plans demonstrated poor design and would not match the existing streetscape. The council noted the road frontage in this location comprises exclusively commercial establishments, with no ground-floor homes currently in existence. Introducing a residential use at ground level would, according to the town council, undermine the continuity of the shopping area and contradict the established development pattern. The authority maintained the scheme would damage the visual character of the streetscene and did not represent good design.
Additional objections concerned road safety implications and the removal of a commercial property from the local economy.
Planning officers observed in their assessment that many of these objections fall outside the narrow scope of considerations permitted under Class MA permitted development provisions.
In their report, council planning officers acknowledged the town council’s submissions while explaining that issues surrounding retail frontage reduction, marketing efforts, commercial demand and area character fall outside the prior approval matters assessable under Class MA regulations. Road safety considerations were addressed within the relevant section of the report.
Regarding transportation impacts, officers concluded the scheme would not generate unacceptable effects on traffic flow or compromise road safety.
