Brighton man charged £400 for rental car damage he denies causing

A Brighton resident has been issued with a £400 bill for alleged damage to a hire vehicle which he maintains he could not have caused.

Jake Fearnside reserved an Enterprise Car Club automobile to transport his mother following a Raye performance at Pride on the Park on August 1.

Approximately a fortnight subsequently, the window cleaner was informed that a technician had identified a deflated tyre attributable to a missing dust cap, which he asserted represented clear vandalism.

He was required to settle the cost for a complete wheel replacement despite insisting the fault could not have arisen during his journey.

Speaking on the matter, Fearnside commented that the situation proved deeply irritating, noting that no human consideration had been applied and that automated systems had simply rejected his objection.

The 32-year-old had recently relocated to accommodation at Denman Place, where the tenancy package incorporated two years of complimentary membership to the Enterprise Car Club scheme.

This programme enables members to book vehicles stationed at multiple sites nationwide, including two units positioned at his residential building.

Fearnside explained that his mother had attended the Raye concert at Preston Park and that hiring the vehicle seemed a practical solution given her residence in Haywards Heath, removing the need for taxi arrangements.

Upon completing his journey, he returned the car to its designated bay and expressed satisfaction with the overall experience.

As the return occurred around midnight, he did not photograph the exterior, reasoning that any potential dispute would likely involve minor scuffing invisible on a dark-coloured vehicle under those lighting conditions.

The self-employed individual stated the automobile remained in pristine condition upon his departure.

On August 17, more than fourteen days following the return, Enterprise contacted Fearnside to report that an inspection had uncovered a flat tyre.

Subsequent to receiving this communication, he examined the vehicle personally and observed that the dust cap had been completely removed.

He characterized this as evident deliberate damage, contending that such an occurrence could not have taken place during normal driving.

Fearnside observed that even without mechanical expertise, anyone would understand that such an event while travelling would have resulted in immediate tyre deflation, rendering the vehicle uncontrollable or necessitating roadside assistance, with no possibility of completing the journey home.

Furthermore, during the intervening fortnight between the parking and the technician’s examination, Fearnside stated that no other individuals had operated the vehicle.

Consequently, he concluded that the automobile had remained stationary on the public highway throughout this period.

Despite presenting these arguments to Enterprise, the company maintained that without supporting imagery, it remained unproven that the damage had not occurred during his rental period, and proceeded to levy the £400 charge.

Enterprise indicated that any sum exceeding the actual repair cost would subsequently be refunded.

Fearnside noted that the complete tyre assembly had been substituted and subsequently challenged Enterprise’s justification for this approach rather than simply fitting a replacement dust cap.

He expressed disbelief that customers utilizing these distributed vehicles across the city for brief periods could face full replacement costs if they neglected to document the vehicle’s condition, particularly given that such automobiles remain parked on streets without continuous monitoring and lack comprehensive records regarding when damage might have occurred.

An Enterprise Car Club representative stated that preserving customer relationships remains a fundamental objective, and when concerns are raised, every effort is made to investigate thoroughly and resolve matters promptly.

Following additional review, the company determined to withdraw the claim.

The organisation indicated its willingness to engage with customers who dispute damage allegations, noting that individuals may request further examination of their cases at any time.
